Synopsis
Competition Law in the UK and the EU: Recent developments in the case-law of the Competition Appeal Tribunal and the Community Courts
Professor Whish will review the recent case-law of the Competition Appeal Tribunal in the UK and the European Community Courts in Luxembourg. In particular he will discuss:
- the meaning of the terms 'agreement' and 'concerted practice', which the Competition Appeal Tribunal has considered in several cases

the distinction between agreements that have as their 'object' the restriction of competition and agreements that have the 'effect' of doing so
-
the treatment of joint selling arrangements
-
the position of third party complainants in competition proceedings
-
various procedural issues such as privilege against self-incrimination and the Courts' attitude towards fines
