Public Seminar by Prof Richard Whish

Synopsis

Competition Law in the UK and the EU: Recent developments in the case-law of the Competition Appeal Tribunal and the Community Courts


Professor Whish will review the recent case-law of the Competition Appeal Tribunal in the UK and the European Community Courts in Luxembourg. In particular he will discuss:

  • the meaning of the terms 'agreement' and 'concerted practice', which the Competition Appeal Tribunal has considered in several cases
  • the distinction between agreements that have as their 'object' the restriction of competition and agreements that have the 'effect' of doing so
  • the treatment of joint selling arrangements
  • the position of third party complainants in competition proceedings
  • various procedural issues such as privilege against self-incrimination and the Courts' attitude towards fines
