Merger Review in the 2020s: the Challenges of Digitalization, Globalization, and the Evolution of Merger Analysis

The International Competition Network (ICN) Annual Conference Merger Working Group Plenary explored the evolution of Merger Review in the 2020s. Digitalization and globalization are two major influencers on the evolution of competition policy. The panel discussion explored the following:

  • What are the characteristics of mergers in the digital economy?

  • Is merger review in the digital economy different and what are the challenges?

  • Does globalization influence market definition and competition analysis?

  • How can international cooperation help agencies to address multijurisdictional merger review?

  • How should agencies and parties deal with coordination of extraterritorial remedies? Is ex-post evaluation of merger decisions a useful diagnostic tool?

CCCS’s Chief Executive, Toh Han Li, participated in the panel discussion alongside Tembinkosi Bonakele (Commissioner, South African Competition Commission), Juan Pablo Herrera (Deputy Superintendent, Competition Protection of Colombia), Andreas Mundt (President, Germany Bundeskartellamt) and Joseph Simons (Chairman, US Federal Trade Commission). The session was moderated by Melanie Aitken, Managing Principal of Bennett Jones (US) LLP.
