Fast Track Procedure
The procedure facilitates the resolution of investigations into infringements of sections 34 or 47 of the Competition Act 2004 benefitting both businesses and CCS administratively.
Overview
The CCS Guidelines on the Fast Track Procedure introduces a higher discount for businesses that successfully resolve infringements under the Fast Track Procedure (“Fast Track Discount”) and streamline the application and approval process.
For businesses, the Fast Track Procedure not only reduces business costs, but also provides a clear and expedient path to closure, allowing them to reduce operational uncertainty and management time needed to address CCS’s findings. Administratively, it provides procedural efficiencies and resource savings for all.
Up to 30% Discount in Financial Penalties
The Fast Track Discount of up to 30% is applied to the financial penalty after other adjustments and discounts such as leniency. For example, a party receiving both a 50% leniency and 30% Fast Track Discount would receive an overall penalty reduction of 65%. Applying before a proposed infringement decision is issued would likely result in a higher discount.

Requesting Fast Track Procedure
