Qualifying Foreign Law Practices

CCS clarifies the role of Qualifying Foreign Law Practices (QFLPs) in assisting clients with competition matters, outlining permitted legal services, representation guidelines, and compliance requirements in Singapore.

The Competition and Consumer Commission of Singapore (“CCS”) has clarified with both the Attorney-General’s Chambers (“AGC”) and the Ministry of Law on the extent a Qualifying Foreign Law Practice (“QFLP”) can assist a client with CCS matters.

A QFLP can provide legal advice and make representations, including oral representations, on behalf of their clients for all matters before CCS staff, but only (1) through lawyers registered under section 36B or section 36E of the Legal Profession Act, and (2) strictly within the permitted areas of legal practice as provided under rule 4 of the Legal Profession (Regulated Individuals) Rules 2015.

Accordingly, CCS may request a QFLP representing any client in CCS proceedings to provide a list of their lawyers registered under section 36B or section 36E of the Legal Profession Act, setting out the names and registration numbers issued by the Legal Services Regulatory Authority, as well as the respective validity of their registration.
